My own wife's recent fall with her favorite Taco place can be an illustration of the premise liability risk that a lot of businesses have. Your business has a legal duty to supply a reasonably safe
accommodation. Many claims for retailers, restaurants, garages and other "Open to the Public" businesses are driven by a client tripping on principle and being injured. But if the premise presents
an unusual or heighten hazard to someone venturing onto it, whether customer, supplier and passerby, your business is usually venerable. This article presents some examples of premise hazards and a
guide to how to inspect your property to reduce this chance. Liability coverage for premise or "Public liability" is an important component of the general Liability business insurance contract.
A few Public Liability Examples
Such as any veteran insurance jeweler, I have my "war stories" of so what can happen. Per Dragnet, your events are true; only the names have been completely changed (actually omitted) to safeguard
the innocent. Here are generally some:
During a site inspection of a flat complex, I nearly put my foot within a hole resulting from settling of an utility access port in the sidewalk. This could get easily broken an foot. As the
property owner, you could be held responsible for this clear hazard.
At the same apartment complex is a pen with a big aggressive dog owned by the tenant. While the enclosure is marked "Beware of the Dog" (an admission with the potential danger) it presents an
exceptionally high hazard for children or other residents. As i approached the area to get a picture, the dog billed the fence. As the home owner, you could be held liable for allowing this clearly
aggressive dog on the property (the apartment manager had given permission for the enclosure).
For a chicken restaurant I insure there seemed to be an incident where litigant tripped in a divot inside parking lot. A excellent ruckus then resulted with screaming and accusations. An important
lawsuit was filed for any injury, pain and producing lost wages. The claim was defended by the insurance company with the only settlement offer for immediate medical bills. Claim investigator
suspected that this injury was staged for the purpose of causing a lawsuit.
A recent visit to a client's restaurant illustrates another sort of lawsuit risk. Lunch has been great, but a visit on the "necessaries" demonstrated a lack of reasonable care with a bottle of
caustic cleaner in easy reach. How large would the lawsuit get if that cleaner was swallowed by the child?
Parking lots is a high risk area for shopping centers. A motorcycle hits sidewalk damaged by undercutting after a freak rainstorm throwing that rider and heavily destroying the bike. A broken
handicap warning sign mount is tripped over resulting in a shopper's injury. A center is accused of running lawn sprinklers during freezing weather causing a shopper to slip (this was successfully
defended as the sprinkler's water had been put off for the season).
One of the best Asian Fusion lunch buffet has just washed the front entrance to the restaurant much like the lunch crowd can come.
